1. Acceptance of Terms

By accessing and using the Utoplearn Academy website, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Our Platform provides one-on-one online tutoring services in the following subjects:

  • English Language
  • Educational Research
  • Editing and Proofreading
  • Presentation and Public Speaking
  • IELTS/TOEFL Exam Coaching

3. User Registration and Accounts

3.1 Account Creation

  • Users must provide accurate, current, and complete information during registration
  • Users are responsible for maintaining the confidentiality of their account credentials
  • Users must notify us immediately of any unauthorized use of their account
  • You must be at least 13 years old to create an account (users under 18 require parental consent)

3.2 Account Responsibilities

  • Users are responsible for all activities that occur under their account
  • Users may not share account access with others
  • False or misleading information may result in account termination

4. Booking and Scheduling

4.1 Class Booking

  • All classes must be booked through the Platform’s scheduling system
  • Bookings are subject to tutor availability
  • Students will receive confirmation and Zoom meeting details upon successful booking

4.2 Rescheduling Policy

  • Classes may be rescheduled with at least 12 hours’ notice directly through student dashboard
  • Rescheduling requests with less than 12 hours’ notice may incur additional fees
  • Emergency rescheduling will be considered on a case-by-case basis

4.3 Cancellation Policy

  • Student Cancellations:

    • 12+ hours notice: Full refund or credit
    • Less than 12 hours: No refund, credit at discretion
    • No-show: No refund or credit
  • Tutor Cancellations:

    • Full refund or free rescheduling
    • Reasonable advance notice will be provided when possible

5. Payment Terms

5.1 Pricing and Fees

  • All prices are listed in USD and include applicable taxes
  • Prices are subject to change without notice
  • Payment is required at the time of booking unless alternative arrangements are made

5.2 Payment Methods

  • We accept major credit cards, debit cards, and other payment methods as displayed
  • All payments are processed through secure, third-party payment processors

5.3 Refunds

  • Refunds are processed according to our cancellation policy
  • Processing time for refunds may take 10-15 business days
  • Refunds are issued to the original payment method
  • Refunds exclude processing fees and any additional payment processing charges

6. Learning Materials and Content

6.1 Intellectual Property

  • All learning materials, including quizzes, audio/video guides, and course content, are proprietary
  • Users receive a limited, non-exclusive license to use materials for personal learning purposes only
  • Materials may not be shared, reproduced, or distributed without written permission

6.2 User-Generated Content

  • Users may submit assignments, projects, or other content for review
  • By submitting content, users grant us a limited license to use such content for educational purposes
  • Users retain ownership of their original work

7. Technology Requirements and Platform Use

7.1 Technical Requirements

  • Reliable internet connection required for video sessions
  • Compatible device with camera and microphone for Zoom sessions
  • Updated web browser for optimal platform performance

7.2 Platform Usage Rules

  • Users must not interfere with platform security or functionality
  • Prohibited activities include hacking, data mining, or attempting to gain unauthorized access
  • Users must not upload malicious software or engage in disruptive behavior

8. Code of Conduct

8.1 Professional Behavior

  • All interactions must be respectful and professional
  • Harassment, discrimination, or inappropriate behavior is prohibited
  • Users must maintain appropriate dress and behavior during video sessions

8.2 Academic Integrity

  • Plagiarism or cheating is strictly prohibited
  • Users must not share login credentials or allow others to attend their sessions
  • Violation of academic integrity may result in immediate account termination

9. Privacy and Data Protection

9.1 Data Collection

  • We collect personal information necessary to provide our services
  • Session recordings may be stored for quality assurance (with prior notice)
  • User data is protected according to our Privacy Policy

9.2 Third-Party Integrations

  • Zoom sessions are subject to Zoom’s terms of service and privacy policy
  • Payment processing is subject to our payment processor’s terms and privacy policies

10. Limitation of Liability

10.1 Service Limitations

  • We strive to provide high-quality educational services but cannot guarantee specific outcomes
  • Technical issues beyond our control may occasionally affect service delivery
  • Our liability is limited to the amount paid for the specific affected service

10.2 Disclaimer of Warranties

  • Services are provided “as is” without warranties of any kind
  • We do not warrant that the platform will be error-free or continuously available
  • Users are responsible for their own technical setup and internet connectivity

  • Serious violations may result in immediate termination without refund
  • Users will be notified of termination and provided with reasons when possible
